U.S. State Privacy Notice
We’ve created this U.S. State Privacy Notice to provide additional information for residents of California, Nevada, Virginia, Colorado, and Connecticut. Users in these states have certain privacy rights as specified under state law. Our Privacy Principles and the privacy controls we offer to all users are in line with these laws. For example, all users can request a copy of their data, request deletion, and control their privacy settings in the app.





Your Rights


Right to obtain personal information we collect and correct it


You have the right to request details on specific personal information we've collected about you and the right to correct inaccurate information. You can access and edit most of your basic account information right in the Rave app from the profile and watch history screens. If you'd like to obtain a copy of your information that isn't available in our apps in a portable format you can contact our DPO (Data Protection Officer) at [email protected].


Right to get a timely response


You have the right to make two free request in any 12-month period. Responses to your request must be returned within 45 days, and in more difficult cases, we may extend our response by another 45 days. Our support team is pretty great, so they tend to respond a lot quicker.


Right to deletion


You have the right to request deletion of your data, unless exception applies. Examples of exceptions include when we need to keep data to meet legal obligations, detect fraud, investigate reports of abuse, or other Terms and Services violations, or fix security issues. We will delete your data 30 days after a successful request.


Right to know who we share your data with


We share your data with service providers to store and host your data as well as perform large scale analytics of trending content. We also derive and share market verticals based on watch history for monetization purposes including to improve the quality of ads you receive. Right to Non-Discrimination


It goes without saying, but we will not hold it against you when you exercise any of your rights. In fact, we encourage you to review your privacy settings closely and reach out to us with your questions.





Specific Data Collection


We collect information to offer you the best possible service. This begins by designing our systems with privacy as the starting point. We do not collect more information than necessary or collect information for purposes that are different, unreleated, or incompatible with what's detailed in our privacy policy. In the last 12 months, we've collected the following personal information:


A. Identifiers - we collect name, user name, handle, e-mail address, IP address, and advertising identifiers.


B. Personal information categories listed in the California Customer records - we collect name.


C. Characteristics of protected classifications under California or federal law - we collect age. The main purpose for collecting this information is to verify your age for mature content and to show you more relevant content.


D. Commercial information - we collect commercial information related to being a premium Rave member.


E. Internet or other electronic network activity - we collect your watch history.


F. Geolocation data - With your consent, we collect your physical location. We use your location to display your avatar on the map, as well as match you to Raves nearby to your physical location.


G. Audio, electronic, visual, or similar information - we collect your chat, chat images, and voice as the basis of what make a Rave function.


H. Inferences drawn from other personal information - we make inferences based on your watch history, of content we think you may enjoy watching.


I. Permissioned personal information - With your consent, we collect your precise geolocation and voice chat. We used this information to make features available that rely on this infomration, like the map and in Rave voice chat.





California


If you live in California, you have additional rights as provided by the CPRA:


Right to limit the use of your sensitive information to infer charactersitcs about you


Rave does not collect sensitive information and so we do not infer characterisitcs about you using this information.


Right to opt-out of sale


All users, including Californias, can opt-out of data collection from the settings menu and thus data sale. By agreeing to Rave's data policy you agree to the sale of your data.





Nevada


If you live in Nevada, you can opt-out of the sale of information covered under Chapter 603A of the Nevada Revised Status. All users, including Nevadans, can opt-out of data collection from the settings menu and thus data sale. By agreeing to Rave's data policy you agree to the sale of your data.





Virginia, Colorado, Connecticut


If we deny your rights request, you have the right to appeal that decision. We will provide you with the necessary information to submit an appeal at that time.


You have the right to opt out of targeted advertising. All users can opt-out of data collection from the settings menu and thus data sale. By agreeing to Rave's data policy you agree to the sale of your data.


You have the right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning the consumer. Rave does not engage in such profiling as defined by this law, so there’s no need to opt out.
European Economic Area and UK Users
This notice provides additional information for users in the European Economic Area (EEA) and the United Kingdom (UK). Users in the EEA and UK have certain privacy rights as specified under EU and UK law, including the General Data Protection Regulations (GDPR) and UK Data Protection Act 2018. Our Privacy Principles and the privacy controls we offer to all users are in line with these laws. This notice makes sure we cover the EEA and UK-specific requirements. For example, all users can request a copy of their data, request deletion, and control their privacy settings in the app.

When initializing Rave, you are prompted with the ability to opt-in to Rave's data policy and thus data collection. Raves custom features, such as content and friend recommendation may no longer function optimally if opt-in is not selected.

You have the right to opt-out of processing of personal data. All users can opt-out of data collection from the settings menu and thus data sale. By agreeing to Rave's data policy you agree to the sale of your data.





Basis for Using Your Information


Consent


If you are part of the EEA and UK, we'll ask for consent to use your information. If you offer consent, and later opt-out from our settings, we'll make sure your choice is reflected in our services. Even if we're not relying on consent to use your information, we may ask you for permission to access data like contacts and location.


Legitimate Interest


Another reason we might use your information is because we have — or a third party has — a legitimate interest in doing so. For example, we need to use your information to provide and improve our services, including protecting your account, delivering your messages, providing customer support, and helping you find friends and content we think you'll like. Because most of our services are free, we also use some information about you to try and show you ads you'll find interesting. An important point to understand about legitimate interest is that our interests don't outweigh your right to privacy, so we only rely on legitimate interest when we think the way we are using your data doesn't significantly impact your privacy or would be expected by you, or there is a compelling reason to do so.

We want you to know that you can submit any inquiries to our Data Protection Officer at [email protected]. You also have the right to file a complaint with the supervisory authority in the EEA and in the UK you can file a complaint with the Information Commissioner’s Office.
Brazilian Users
We’ve created this notice specifically for users in Brazil. Users in Brazil have certain privacy rights as specified under Brazilian law, including the Lei Geral de Proteção de Dados Pessoais (LGPD). Our Privacy Principles and the privacy controls we offer to all users are in line with these laws—this notice makes sure we cover the Brazil-specific requirements. Your Rights


Right to Object or Challenge


You have the right to object to or challenge our use of your information. With many types of data, we’ve provided you with the ability to simply delete it if you don’t want us processing it anymore. For other types of data, we’ve given you the ability to stop the use of your data by disabling a permission altogether.
